Welcome to the Fresh N Fitted web store. Please review the following basic terms that govern your use of, and purchase of, products from our site. Please note that your use of our site constitutes your agreement to follow and be bound by those terms.


Use of Website

You agree to use this website for lawful purposes only. Any misuse, fraud, abuse, or unauthorized access may result in account termination and legal action.

Product Information

We make every effort to display product descriptions, images, and pricing accurately. However, we do not guarantee that all content is error-free. Product colors may vary due to screen settings.

We reserve the right to correct errors, cancel orders, or update product information at any time without prior notice.

Pricing & Payments

All prices are listed in U.S. dollars. We reserve the right to refuse or cancel orders due to pricing errors, suspected fraud, or unauthorized activity.

Orders will not be processed or shipped until payment is fully authorized and verified.

Orders, Shipping & Delivery

SHIPPING:
For domestic orders please allow 2-5 business days after order has been processed for delivery.
We Ship out of Concord California so the closer you are the faster you will receive it. 

For international orders please allow 3-10 business days after order has been processed for delivery and depending on country of product destination additional delays may concur. 
Depending on the country, International customs can hold a package for additional time to verify the products being delivered are safe and meet there country's guidelines. 

INTERNATIONAL ORDERS:

**International orders are subject to Duties, Customs, and Value Added Taxes. These charges MUST be paid upon receipt of your order. Be sure to verify the additional cost that may have been incurred with the authorities of the country the order is being shipped to. THE FRESH N FITTED ONLINE SHOP is not responsible for additional fees requested by the Mail Carrier or Customs.

USPS, UPS, and Fed Ex offers direct and reliable confirmation through their carriers through out The United States of America, whether a package has been successfully delivered to the correct address listed on your order. International Orders are subject to their countries rules and laws regarding shipping and customs once the item leaves USA soil it is up to the customer to check with local authorities to check on the status of there order.  (Customers are sent a tracking number once their order has been fulfilled via the e-mail address they list on their order. If you happen to not receive your tracking number, please notify us via e-mail immediately.)

Shipping Policy for The Fresh N Fitted

At The Fresh N Fitted, we strive to ensure that your orders are processed and shipped promptly. Once your order leaves our warehouse/store’s, it is in the hands of the shipping carrier, and we no longer have control over the package during transit.

Order Status

• In Transit: While your order is in transit, tracking information will be provided for you to monitor the progress of your delivery. If there are any delays or issues, we recommend contacting your local delivery carrier directly for more information on the status of your package.
• Delivered: Once the tracking information shows that the package has been marked as “Delivered,” we consider our part in the shipping process complete. If you cannot locate your package, please reach out to your local delivery company to investigate further.

Undelivered Packages

• If tracking shows the package has not been delivered: In cases where the tracking information indicates that your package has not been delivered, and there appears to be an issue with the delivery, we will take full responsibility. You may contact us, and we will either ship out a replacement or, if the item is no longer available, we will issue you a store credit for the amount of your purchase.

Exceptions

• Lost or stolen packages after delivery confirmation: Unfortunately, once the package has been marked as delivered by the carrier, The Fresh N Fitted cannot be held responsible for lost or stolen items. We advise checking with your local postal service, neighbors, property management, for assistance.

All orders will come with a tracking number.

Orders may be modified prior to shipment by contacting customer support. Once shipped, all orders are final and can not be modified.

Shipping timelines are estimates only. Fresh N Fitted is not responsible for carrier delays, lost packages once marked delivered, or delivery issues outside our control.

Returns & Exchanges

Refund & Return Policy

We want you to be satisfied with your purchase. Please review our policy carefully before submitting a return request.

30-Day Return Window

Returns are accepted within 30 days of delivery.

To be eligible for a return:

  • Items must be unworn, unwashed, and in original condition

  • Original tags must be attached

  • Items must be returned in original packaging, if applicable

Items showing signs of wear, damage, odor, or alteration will not be accepted.

Refunds

  • Approved returns will be refunded to the original form of payment

  • Shipping costs are non-refundable

  • Refunds are processed after the item is received and inspected

  • Please allow 5–7 business days for the refund to reflect after processing

Exchanges

  • Marked-down / sale items are exchange only

  • No refunds on discounted items

  • Exchanges are subject to availability

For exchanges only, simply email us:

  • Your return tracking number

  • The item you are exchanging

Once this information is received, we can issue a store gift card immediately, allowing you to place a new order right away—no need to wait for the item to arrive and be processed.

Final Sale Items

Items marked Final Sale are not eligible for returns or exchanges.

How to Start a Return

Before shipping your return, please contact us via email and include:

  1. Photos of the item(s) you are returning

  2. Your order number

  3. Your tracking number once shipped

Returns sent without prior contact or approval may not be accepted.

Return Shipping Instructions

All returns and exchanges must be shipped via insured, trackable mail in a secure package.

We are not liable for packages lost in transit. Customers are responsible for retaining tracking information and proof of shipment.

Damaged or Incorrect Items

If you receive a damaged or incorrect item, please contact us within 48 hours of delivery with photos so we can assist you.

Fraud, Chargebacks & Abuse

We actively monitor transactions for fraud.

By placing an order, you agree that:

  • Filing a chargeback without first contacting us may be considered fraudulent activity

  • We reserve the right to submit order records, delivery confirmation, IP address data, tracking information, and communication history to payment processors and banks

  • Accounts with excessive chargebacks or suspicious activity may be permanently restricted

False claims of non-delivery or unauthorized purchases may result in denial of future service.

California Consumer Rights

Under California law:

  • Customers may request access to or deletion of personal data as outlined in our Privacy Policy

  • Consumers may contact the California Department of Consumer Affairs if unresolved disputes arise

Fresh N Fitted complies with all applicable California consumer protection laws.

Intellectual Property

All site content—including logos, designs, graphics, text, and images—is the exclusive property of Fresh N Fitted and may not be copied or used without written permission.

Limitation of Liability

To the fullest extent permitted by law, Fresh N Fitted is not liable for indirect, incidental, or consequential damages arising from use of our site or products.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

We reserve the right to update these Terms at any time. Changes take effect immediately upon posting.
